Has Life Thrown A Curve Ball At You Or Your Business?

When you are struggling with the stress of overwhelming debt issues, it can be difficult to conduct other areas of your life. An accident injury, illness, loss of a job, divorce or death of a family member can result in an inability to keep up with your bills. Our team can help with a variety of debt relief options through filing for bankruptcy. Bankruptcy offers you the chance to get a fresh financial start, but the issues can be complicated. There are different chapters of bankruptcy, and each has unique standards that must be met to qualify. We are here to help you, not to judge you. We will talk with you about your situation and help you determine your best option.

Chapter 7 bankruptcy is the most common type of bankruptcy. It is available to individuals, partnerships, corporations and married couples. This type of bankruptcy discharges unsecured debts. One benefit is, if your debts are discharged, creditors cannot take any collections actions against you. It usually takes from four to six months after filing to complete a Chapter 7.

Chapter 13 bankruptcy provides debt relief by allowing individuals to arrange a repayment plan with their creditors. To qualify, you must have regular income and your secured debt (which is property creditors might be able to take if payments are not made) must be less than $922,975, while you must have less than $307,675 in unsecured debt. Chapter 13 is useful for helping you avoid foreclosures and repossessions.

Filing for Chapter 11 bankruptcy is primarily for business reorganization. Businesses filing Chapter 11 bankruptcy become debtor-in-possession. A bankruptcy trustee is not immediately appointed. Businesses are allowed to work with their creditors to structure payments for repaying debt. Once it is confirmed by the court, it binds the debtor and the creditors to repayment terms.
